IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION APPEAL FROM ORDER NO.468 OF 2015 Dinkar Tatyaba Jadhav Through his Constituted Attorney Mrs. Kalpana Fattesingh Bhosale : Appellant.

Versus

Mrs. Chhaya Sanjay Jadhav : Respondent.

Mr. R V Sankpal for the Appellant.

CORAM :

R. M. SAVANT, J.

DATE :

09th June 2016 P.C.

The learned counsel for the Appellant states that the Appellant is aggrieved by the fact that the Notice of Motion invoking Order VII Rule 11 of the Code of Civil Procedure for dismissal of the suit has been dismissed by the Trial Court. The learned counsel for the Appellant further states that he is not much aggrieved by the order rejecting the prayer for temporary injunction. If that be so, the Appellant would have to adopt appropriate remedy against the impugned order rejecting the Notice of Motion invoking Order VII Rule 11 of the Code of Civil Procedure. The above Appeal from Order is not maintainable. With the liberty to the Appellant to adopt the appropriate remedy, the above Appeal from Order is disposed of as not maintainable. [R.M.SAVANT, J] lgc
