Heard Mr. Karan Jain, the learned Counsel for Applicant. 2.

The Applicant is seeking regular bail in Crime No. 82 of 2018 for an offence punishable under sections 302, 201 read with Section 34 of Indian Penal Code. The Applicant came to be arrested on 25th March 2018.

The victim was having illicit relations with the Accused No.1 - Vipul Shah who was into a business where the Applicant - Accused No.2 was working as a Helper. The case of the prosecution is, the victim girl

2/3 Yadav 15.ba.178.19 had tried to blackmail the Accused No.1 - Vipul Shah, as such he strangulated the victim. As such, a motive can be inferred against the Accused No.1 - Vipul Shah.

As far as the present Applicant - Accused No.2 is concerned, at the most from investigation it could be prima facie noticed that the role attributed to him is to the extent of an offence punishable under Section 201 of IPC. There is no specific motive but for acting in aid of the main accused i.e. his master.

In the aforesaid background, a case for bail is made out. Hence, the following order.

ORDER

(A) The Applicant be released on bail in Crime No. 82 of 2018 for an offence punishable under sections 302, 201 read with Section 34 of Indian Penal Code on executing PR bond of Rs. 25,000/- with one or more sureties in the like amount.

(B) The Applicant shall neither tamper the evidence of prosecution nor influence the prosecution witnesses.
