Heard the learned Counsel for the petitioner and the respondent in person.

The short grievance of the petitioner in this petition is that despite the order of stay granted by the Division Bench of this Court on 6/7/2011 in Writ Petition No. 4897 of 2011, respondent filed application before the Central Information Commission. Though ultimately, this application is dismissed, it is the case of the petitioner that the application was filed by the respondent before the Central Information Commission without disclosing the above said order. 43.cp66.12.doc In our considered view, it is not the case of the petitioner that the respondent has committed breach or willful disobedience of the court order. Therefore, civil contempt petition would not be maintainable. At the most, it can be said that the respondent has suppressed the order of this court referred above. However, that may not give rise for action for civil contempt under Contempt of Courts Act. We therefore, do not want to proceed further. Hence, Contempt Petition is dismissed.
