The above Writ Petition is filed inter alia seeking to quash and set aside the notification dated 23rd June 2021 issued by Respondent No.1. The consequential relief also sought is to quash and set aside the order of the Collector, Beed dated 1st December 2023, whereby the name of MIDC has been inserted in the subject property namely Gat No.343, Sirsala village, and which was pursuant to the said Digitally signed by ASHWINI JANARDAN VALLAKATI Date:

The Learned AGP appearing on behalf of the State took a JANUARY 16, 2024 Ashwini Vallakati

502-ASWP-697-2024.doc preliminary objection to the maintainability of this Writ Petition on the ground that the property in question is situated in the District Beed and which would fall within the jurisdiction of the Aurangabad Bench of this Court.

Faced with this objection, the Learned Advocate appearing on behalf of the Petitioners, sought leave to withdraw the above Writ Petition with liberty to file the same before the Aurangabad Bench. 4.

In these circumstances, the above Writ Petition is dismissed as withdrawn with liberty as prayed. We may clarify that we have not opined on the merits of matter one way or the other and the same shall be decided on its own merits and in accordance with law, as and when the Writ Petition is heard by the Aurangabad Bench. 5.
