By consent of the Learned Counsel for the parties i.e. Mr. S. S. Patwardhan and Mr. A. A. Joshi, the order dated 13.12.2016 passed by the Learned Member of the Maharashtra Revenue Tribunal and the order dated 13.08.2008 passed by the Sub Divisional Officer, Khanapur, would stand set aside, as also the orders dated 29.12.2003 and 14.07.2004 passed by the Tahsildar would stand set aside and the matter would stand relegated back to the Agricultural Lands Tribunal (For short "ALT) and Tahsildar, Taluka Khanapur (Vita), District Sangli for a de-novo consideration of the application under Section 32G r/w 32O filed by the Petitioner. Needless to state that the said application would be tried on it's own merits and in accordance with law. The contentions of the parties are kept open for being urged before the ALT & Tahsildar, Khanapur BGP.

(Vita). Since the proceedings have been going on for number of years, on remand the proceedings are expedited and the ALT & Tahsildar, Khanapur (Vita) may dispose of the same at the earliest. The parties to maintain status-quo pending the proceedings before the ALT & Tahsildar, Khanapur (Vita). The Writ Petition is accordingly disposed of. [R.M.SAVANT, J] BGP.
