1] This is an application under Section 439 of Cr. P.C. for bail in CR No.I-520 of 2018 dated dated 7.10.2018 registered with Mumbra Police Station, Thane under Section 370(2)(3) of the Indian Penal Code and under sections 3,4 and 5 of the Prevention of Immoral Trafficking Act 2] Heard the learned Counsel for the applicant and the learned APP. Perused the chargesheet.

3] It is the prosecution case that, that on receipt of specific information, the police conducted raid at the residence of the applicant and found two women indulging in the vocation of prostitution. The allegation against the applicant is that, she was indulged in conducting illegal activity 1/2

During the course of investigation, the police arrested the applicant on 7.10.2018 and submitted chargesheet. 4] The statements of the victim ladies, aged about 36 years and 27 years respectively would indicate that, they indulged in the vocation of prosecution of their own will to earn their livelihood and to support their families. That they hail from the lower economical strata of the society. 5] After perusing of the chargesheet and the statements of victim ladies, this Court is of the view that the applicant can be released on bail. Hence the following Order:

i] Applicant be released on bail in CR No. I-520 of 2018 registered with Mumbra Police Station, Thane, on her furnishing PR bond of Rs.25,000/- with one or two solvent local sureties in the like amount. ii] The applicant shall attend all the dates before the Trial Court unless granted exemption by the concerned Court. iii] Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.
