The Learned APP submitted that in the records and proceedings, there is an affidavit of original complainant Shobha Dnyandeo Bhongale dated 23-8-2005, affirmed before the Assistant Superintendent, Civil/Criminal Court, Pimpri, in which complainant has averred that she has compounded the matter after this appeal was filed and she is residing along with accused and cohabiting happily.

I have to note that before this affidavit was cited, I went through the evidence and found no merit in any case, to interfere with the impugned judgment.

In view of the above, the appeal disposed.
