The Interim Application is preferred for relaxation of conditions of bail granted by Order dated 25th October 2023 passed by a learned Single Judge [Coram: M. S. Karnik, J.] in Bail Application No.915 of 2023 along with Bail Application No.917 of 2023. The said condition (d) reads as under :- "(d) Except for attending the trial and for the purpose of reporting to the Investigating Officer, the applicant shall not leave Mumbai/Mumbai Suburban without permission of the trial Court, till the conclusion of the trial."

As per the said condition, the Applicant is restrained from leaving Mumbai City or Mumbai Suburban district without due permission of the learned Trial Court, till the conclusion of the

Ms. Swati Khot, learned Counsel appearing for the Applicant states that the Applicant has to attend the trial outside Mumbai City/Mumbai Suburban district. However, the said condition (d) clearly specifies that permission of the learned Trial Court be taken for leaving Mumbai City/Mumbai Suburban district.

Accordingly, the Interim Application is disposed of as the Applicant can obtain permission of the learned Trial Court to leave Mumbai City/Mumbai Suburban district.

Therefore, relaxation of said condition (d) is not necessary. In the event the Applicant's presence is required out of Mumbai City/Mumbai Suburban district, the permission can be sought from the learned Trial Court.
