By this application the applicant has sought leave to challenge the judgment dated 9/3/2003 whereby the learned Metropolitan Magistrate, 30th Court, Kurla, Mumbai has acquitted the respondent for offence under section 138 of the NI Act. It is noticed that neither the applicant nor his counsel was present on the last date of hearing. Despite opportunity given none present today. Hence, the application is dismissed for non-prosecution. (ANUJA PRABHUDESSAI, J.)
