By judgment and order dated 22.5.2008 passed by the learned Sessions Judge, Mumbai in Sessions Case No. 177 of 2007, the petitioner was convicted under Section 302 read with Section 34 of IPC. Being aggrieved thereby, the petitioner preferred Criminal Appeal No. 488 of 2008. By judgment and order dated 9.7.2015, this Court allowed the appeal. Pursuant

jdk 2 6.crwp.275.15.doc to the judgment and order of acquittal, the petitioner has been released from prison. In this view of the matter, this petition is infructous. Hence, Rule is discharged.
