The applicants-accused are prosecuted for the offence punishable under section 3 (1) (m) of Schedule Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 and the application for bail is rejected by the Additional Sessions Judge, Mangaon-Raigad by order dated 12th January 2017. However, in view of section 14 (A) of Schedule Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 an appeal lies against the order of rejection of bail. I rely on the judgment of Patna High Court in the case of Raghav Nath Jha Vs. The State of Bihar delivered on 27th October 2016 in Criminal Miscellaneous Application No. 25276 of 2016.
