This application is preferred by original opponent for condonation of 60 days delay in filing First Appeal challenging the judgment and award dated 12.9.2013 passed by EmployeesInsurance Court, Mumbai in Application (ESI) No.29 of 2006.
Considering the submissions made by the learned counsel for the Applicant and the averments in Civil Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application. Hence, following order is Mohite 1/2

A) Civil Application is allowed in terms of prayer clause (a) which reads thus:
"(a) That the delay of 60 days in filing the Memo of Appeal may please be condoned and that the appeal be taken on record and ordered to be numbered."
