Heard. Liberty granted to the Applicant to carry out amendment during the course of the day, failing which the Civil Application shall stand dismissed without further reference to the court.

By this Civil Application, the Applicant is seeking to bring on record the legal heirs of deceased Respondent No.1 Jinnappa Annu Karyappa who died on 22.10.2017. The Civil Application filed is within time. Hence, the Applicant may be allowed to carry out amendment by bringing the legal heirs on record of deceased Respondent No.1.

Hence, following order is passed:

The Applicant is permitted to bring on record the legal heirs of deceased Respondent no.1 in the Civil Revision Application.

The amendment shall be carried out on or before 14.12.2018, failing which the Civil Application shall stand dismissed without further reference to the court. c.

If amendment is carried out within stipulated time as stated hereinabove, the Applicant is directed to serve the added Respondent in the Civil Revision Application along with entire proceedings by way of private notice either by RPAD and/or by hand delivery and to file an Affidavit of service to that effect on or before next date. d.
