Heard the learned counsel for the applicant. In my opinion, the delay which is of more than three years is not satisfactorily explained. The grounds taken are of misplacing the papers by the advocate and of ill-health, which are not substantiated. In any case, there is no satisfactory explanation of the enormous delay. I am, therefore, not inclined to condone the delay.
