P.C.:- 1] After earlier prayer for grant of regular bail was rejected, relying on medical certificate dated January 11, 2022 of the wife of the Applicant, release of the Applicant is sought on regular bail. 2] Mr. Saraogi, learned Counsel for the Applicant, apart from merits, has also invited attention of this Court to the fact that Applicant is the only person who can take care of his ailing wife, who requires medical attention.
3] I have gone through the medical certificate issued by the doctor. I am not satisfied with cause cited in support of prayer to grant bail. For consideration and grant of prayer for release of the Applicant on 1/2
13-BA-286-2022.doc the ground that his ailing wife needs his company to attend and take care of her, no convincing material is produced to justify such claim. This Court is required to be sensitive to the fact that on earlier occasion, prayer for grant of bail on merit was withdrawn, as this Court was not inclined to grant the same. FIR was lodged by the victim who was assaulted by the Applicant who later on succumbed to injuries. As such, there is direct evidence available on record about involvement of the Applicant in the serious offence which is punishable with life imprisonment or death. That being so, no case for bail is made out.
4] Bail Application stands rejected.
