Considering the fact that the Petitioner has already filed application seeking permission to reexport the goods to the Commissioner of Customs, it would be appropriate for the Commissioner of Customs to take decision upon the said application.

In view of that the Authority shall adjudicate upon the application seeking permission for reexport on merits and in accordance with law within fifteen days. All contentions of the parties are kept open. Writ Petition is disposed of. No costs.
