The learned A.P.P. on instructions from the concerned officer submitted that the present applicant has already been acquitted in C.C. No.259/PW/2005 arising out of C.R. No.327 of 2004 registered with Paydhuni Police Station, Mumbai. The learned A.P.P. has submitted a report dated 08.09.2016 to that effect signed by the Senior Inspector of Police, Paydhuni Police Station, Mumbai. The same is taken on record. In view of the above, the present application has become infructuous and is disposed of accordingly.
