In the wake of the release of co-accused, Bhavik Vijay Thakkar on bail, under Section 167(2) of the Cr.P.C. read with Section 36-A(4) of the NDPS Act by the Additional Sessions Judge, Kalyan on 14/03/2022, it would be befitting that the applicant approaches the same court, because he is also entitled for the benefit, which was conferred in favour of Bhavik Thakkar.

In the wake of the above, learned counsel seeks permission to withdraw the application with permission to approach the Additional Sessions Court, Kalyan, seeking parity with the coaccused, by order dated 14/03/2022. Needless to state that the application shall be decided by the Additional Sessions Judge, Kalyan, within 10 days from today.
