Respondent No.3 Vasant has expired during the pendency of the appeal. These applications are for bringing the legal heirs of respondent No.3 on record. These applicants were not aware about the death of the respondent No.3 as they were residing at different places/ towns. Hence, for the reasons stated in the civil applications, the same are allowed in terms of prayer

YBG 12-cas-119-121 clauses (a) and (b). Legal heirs be brought on record within two weeks.

2] Ms. Sinhasane, learned Advocate appearing for heirs of respondent No.3 waives service. Appellant's Advocate to supply copies of appeal. Since the appeal is kept for admission, the execution of decree for specific performance is stayed with reference to the actual execution of sale deed. Second Appeal to come up for admission in due course.
