P.C. :- The Petitioner challenges the order passed by the learned District Judge, Pune dated 16 October 2015 refusing to condone the delay in filing the Appeal. Against the order impugned the Second Appeal is maintainable. The learned Counsel for the Petitioner seeks leave to withdraw the Writ Petition to file a Second Appeal. 2.

The order impugned in this Petition was passed on 16 October 2012. The Writ Petition was filed on 12 January 2013 after receipt of the certified copy.

In these circumstances, if the Petitioner files the Second Appeal within period of six weeks from today, the condonation of delay in filing the Second Appeal will be considered favourably. 4.
