The petitioner is accused no. 4 in a case instituted under Section 138 of the Negotiable Instruments Act, 1881. On account of his failure to appear before Trial Court, non-bailable warrant came to be issued against him with a proclamation to secure his presence.

It is informed by learned Advocate for the petitioner that the petitioner was in Chandigarh at the relevant time. He is little over 60 years of age. During Corona Pandemic period, he could not appear before Trial Court. The petitioner now assures to remain present before Trial Court on the next date and on the following dates as well, except in unavoidable circumstances.

In view of the assurance given by the petitioner, the petition is allowed in terms of prayer clause (b).
