IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION REVIEW PETITION (STAMP) NO.1797 OF 2017 IN WRIT PETITION NO.737 OF 2017 The Jammu and Kashmir Bank Limited .... Petitioner.
V/s Smt. Asha Bhan and Ors.
..... Respondents.
Ms. Bijal Vora i/b Clove Legal for the Petitioner. Mr. Jai Chabhria i/b Keystone Partners for the Respondent. CORAM: V. M. KANADE & A.M. BADAR, JJ.
DATE:
JUNE 21, 2017 P.C.:- 1] Not on board, upon mentioning taken on board. 2] Heard the learned Counsel appearing on behalf of the Petitioner. 3] This Review Petition is filed seeking review of the order dated 19/12/2016. The Respondent/original Petitioner had challenged the action of the Bank of deducting certain amounts from her Pension Account and also challenged the action of the Bank of not paying her monthly pension.
4] Brief facts were that the Respondent/original Petitioner's
2/2 RPWST/1797/2017 husband was working with Respondent No.6 - Bank and after her husband died, Respondent/original Petitioner became entitled to get monthly pension.
4] The grievance of the Respondent/original Petitioner was that without giving notice, Respondent No.6 - Jammu and Kashmir Bank Limited had stopped making payment of pension and had withdrawn an amount of Rs 1,57,000./-. By the order under review, we had granted the interim relief. Petition is pending in this Court. Respondent No.6 - Bank had not challenged the interim order passed by us. We do not see any reason to interfere with the said order while exercising our jurisdiction under Order 47 Rule 1. No case is made out for reviewing our order. Hearing of the Writ Petition is expedited. Review Petition is dismissed. Needless to state that all observations made by us in the interim order are prima facie in nautre. (A.M. BADAR, J. ) (V.M. KANADE, J.)
