DATE: JANUARY 08, 2020 P.C.:- 1] Respondent/original Plaintiff initiated suit for declaration, possession and injunction in relation to suit property i.e. Flat No.5, Second Floor, Dinesh CHS Ltd., Kopari Colony, Thane (E) admeasuring 520 sq. ft plus terrace area, total area admeasuring 600 sq.ft. Suit came to be dismissed. However, in the First Appeal, the claim of Respondent/Plaintiff came to be allowed, resulting into initiation of the present second appeal.
2] Parties to the second appeal are real brothers and they have settled the dispute.

(501) sa-284-16.doc 3] Appellants have given up their claim as against the suit property in favour of Respondent/Plaintiff and has reduced terms to that effect as are tendered in this Court, which are taken on record and marked "X" for the purpose of identification.
4] Parties to the appeal and consent terms viz. Kamal, Kailash and Badrinarayan sons of Madanlal Dangra are present in Court and they are identified by their respective Counsel. Appellants Kamal and Kailash admit to the contents of the consent terms. As such, appeal stands allowed in terms of consent terms. Consent decree be drawn accordingly.
