The application is moved for bail. The applicant/accused is facing charge for the offence punishable under Section 302 of the Indian Penal Code in C.R. No. 293 of 2014 registered with Mohol police station, Solapur.

It is the case of the prosecution that one Sandipan Chatake has gave first information report. It is his case that, on 17th August, 2014 when he along with his brother were in the field, his cousin Satyawan Chatake i.e. the applicant/accused fought with him 1 / 3

on trivial issues. Then he threatened them of life. Thereafter, when the complainant and his brother Rajendra Chatake (deceased) were waiting on the road near one canal, the applicant/accused came in a tempo and he deliberately dashed Rajendra Chatake with intention to kill him. Rajendra was sandwiched between the wall of the canal and the tempo and was seriously injured, He died on the spot. The applicant/accused was arrested on 18th August, 2014. Hence, this bail application.

The learned counsel for the applicant/accused has submitted that the applicant/accused is in prison since 18th August, 2014. There are no independent witnesses in this case and the prosecution witnesses are only the family members of the deceased and complainant.

The learned prosecutor opposed the application. She relied on the first information report and the postmortem notes. The postmortem report discloses the cause of death, "due to crush injury right side of chest and right leg".

Perused the postmortem report and the statements of witnesses. It shows the clear involvement of the applicant/accused in the offence of murder. Hence, I am not inclined to grant bail. 6.

Hence, the bail application stands rejected.
