Learned counsel for the Petitioner fairly places on record a Division Bench Judgment of this Court Aurangabad Bench, ( Coram : H. L. Gokhale & P. B. Gaikwad, JJ. ) in the case of Narayan Atmaram Borase vs. State of Maharashtra & ors., reported in 2005(3) ALL MR 410. He submits that in view of the said Judgment, as the remaining dispute of the elected members of the Grampanchayat has come to an end and the subsequent holding of elections, the Petition is rendered infructuous.

Accordingly, the Petition is disposed off as infructuous. Needless to state, that the proceedings which are pending before the Minister against the penalty imposed by the Tahsildar, same are independent proceedings which will be decided by the authority, on its own merits and in accordance with law. 3.
