Leave to amend. Leave is granted. Amendment to be carried out forthwith.

This is an application for suspension of sentence. For the offence punishable under Section 353 read with Section 332 of the Indian Penal Code (IPC) the applicant is convicted and sentenced to suffer simple imprisonment for two years and to pay fine. The applicant is further convicted for the offence punishable under Section 504 read with Section 506(1) of the IPC and sentenced to suffer simple imprisonment for six months each and to pay fine. 1/2

Learned APP opposed the application.

The applicant was on bail during the trial. Considering that the sentence is short one and as the appeal is not likely to be heard any time soon, I am inclined to suspend the sentence. There is nothing on record to indicate that the applicant has misused the liberty while he was bail. The sentence imposed by the Sessions Judge, Pune, vide order dated 26/12/2023 stands suspended.

The applicant be enlarged on bail, on executing PR bond in the sum of Rs.15,000/- with one or two sureties in the like amount.

The applicant shall report once in six months before the trial Court on first Monday of the concerned month commencing from March, 2024.

On being released on bail, the applicant shall furnish his contact number and residential address to the Investigating Officer and shall keep him updated, if there is any change.

The application is disposed of.
