Heard learned counsel for the applicants and learned APP for the Respondent - State.

By this application, the Applicants seek pre-arrest bail, in connection with C.R. No.41 of 2014 registered with the Kalachowki Police Station, Mumbai, for the alleged offences punishable under Sections 418, 420, 465, 467, 468, 470, 471, 120(B) of the Indian Penal Code. 3.
The applicant no.1 at the relevant time was the Branch Manager of Sahyadri Sahakari Bank Limited and the applicant no.2 was
2/3 the Junior Manager of the said Bank - Sahyadri Sahakari Bank Limited. The applicant no.1 superannuated on 28th February, 2013 and is presently working as an advisor of Co-operative Bank Employees Union. According to the prosecution, it is alleged that the applicants had sanctioned and disbursed loans for 112 auto-rickshaws. It is alleged that the said sanction that was granted was by itself was sham and bogus. 4.
Learned Counsel for the applicants state that the scheme was approved by the Board of Directors and pursuant to the interim order granted by this Court vide order 30th January, 2015, the applicants have appeared before the Investigating Officer.

Learned APP states that the police have completed the investigation and that supplementary charge-sheet is likely to be filed within a period of one week. It appears that in the meantime, both the applicants were summoned by the learned Metropolitan Magistrate, Mazgaon Court, Mumbai.

Considering the fact that the investigation is complete and supplementary charge-sheet is likely to be filed within a period of one
3/3 week, the interim order granted by this Court vide order dated 30th January, 2015, is confirmed on the following terms and conditions:-
ORDER
i) In the event of arrest, the Applicants be enlarged on bail furnishing P.R.Bond in the sum of Rs.15,000/- each, with one or two sureties in the like amount ; ; ii) The Applicants shall not tamper or attempt to influence any persons concerned with the case.
iii) The Applicants to co-operate with the conduct of the trial.

The Application is allowed on the above terms. 8.
The aforesaid observations are prima-facie, and the Trial Court shall decide the case on its own merits, in accordance with law, uninfluenced by the observations made in this order. 9.
