By this Interim Application the Applicant is seeking modification of Condition mentioned in Clause No.(b) of the Order dated 4th September 2023 passed by a learned Single Judge in Bail Application No.1990 of 2023. The said Clause No.(b), reads as under:

"(b) The applicant-Janardhan Arvind Parulekar in connection with C.R. No.482/2017 with Hadapsar Police Station, Pune, shall be released on bail on his furnishing P.R. Bond of Rs.10,00,000/- with one or more sureties in the like amount."

Learned Counsel appearing for the Applicant has relied on

the Order dated 22nd January 2024 passed by a learned Single Judge (Coram: Sanjay A. Deshmukh, J) of this Court (Aurangabad Bench) in the case of Janardhan Arvind Parulekar v. The State of Maharashtra in Criminal Application No.293 of 2024. In a similar case, the learned Judge has modified the bail Condition. The operative portion of the said Order dated 22nd January 2024 of a learned Single Judge, is as follows :- "O R D E R I.

The application is partly allowed.

The applicant be released on bail, in connection with Crime No.137 of 2016 registered with Osmanpura Police Station, Dist. Aurangabad for the offences punishable under Sections 406, 420 and 120-B read with Section 34 of the Indian Penal Code and under Sections 3 and 4 of the Maharashtra Protection of Interest of Depositors (In Financial Establishments) Act, 1999, on executing P.R. Bond in the sum of Rs.10,00,000/- (Rupees Ten Lakh) with one surety in the sum of Rs.1,00,000/- (Rupees One Lakh).

It is clarified that the applicant has to furnish P.R. bond of Rs.10,00,000/- (Rupees Ten Lakh Only) and surety of Rs.1,00,000/- (Rupees One Lakh Only)."

Learned APP opposes the Interim Application. However, as learned Single Judge by said Order dated 22nd January 2024 in another Application of the same Applicant has modified the

similar Condition as contained in Clause No.(b) of the Bail Order dated 4th September 2023 passed by a learned Single Judge in Bail Application No.1990 of 2023, the same is modified by directing that instead of Rs.10,00,000/- of surety amount the same be Rs.1,00,000/-.

Accordingly, the said Clause No.(b) is modified as follows:- The applicant-Janardhan Arvind Parulekar in connection with CR. No.482/2017 with Hadapsar Police Station, Pune, shall be released on bail on his furnishing P.R. Bond of Rs.10,00,000/- (Rupees Ten Lakhs Only) with one or more sureties in the sum of Rs.1,00,000/- (Rupees One Lakh Only).

Accordingly, the Interim Application is disposed of in above terms.
