1] This is an application for modification of condition no.3 imposed upon applicant while releasing him on bail by an order dated 28th January, 2014 passed by this Court. By the said order the applicant was directed to attend the Office of the Investigating Agency on every Sunday between 10:00 a.m. to 12:00 noon till the conclusion of the trial. The record reveals that the said condition was subsequently modified by an order dated 20th January, 2015 and the applicant was directed to attend the Office of the EOW, Unit-5 on first Monday of every month till the conclusion of trial. 1/2
OSK 19-appp-49-2016.odt 2] The learned counsel for the applicant submitted that since the date from his release from jail, the applicant is sincerely complying with the afore-stated condition. She further submitted that till date the charge is not framed and investigation is till in process. 3] In view of the above, the condition of attendance imposed upon the applicant by the original order dated 28th January, 2014 and subsequently modified order dated 20th January, 2015 is hereby further modified and the applicant is directed to attend the Office of the EOW, Unit-5 once in three months on every first Monday of the said month between 11:00 am to 2:00 pm.
4] Rest of the conditions imposed upon the applicant by the original order dated 28th January, 2014 are not disturbed. 5] Application is allowed in the aforesaid terms. (A.S. GADKARI, J.) 2/2
