IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE SIDE CONTEMPT PETITION NO.51 OF 2012 Shri Shriniwas Gajanan Marathe ... Petitioner Vs Shri Manish Dalvi, Chairperson, Samartha English Medium School & Others ... Respondents None for the Petitioner Mr.B.V. Samant, AGP, for Respondent - State Mr.M.G. Bagkar i/b C.G. Patil for Respondent No.4 CORAM: S.C. DHARMADHIKARI & R.I. CHAGLA, JJ.

DATED: JANUARY 20, 2020 P.C.:

1.

The Contempt Petition is filed alleging breach of the orders dated 22.4.2010 and 30.4.2010 passed in Writ Petition No.2583 of 2010.

2.

From the roznama, it appears that after 26.4.2016, the date on which notice was issued on this Contempt Petition, the petitioner and the advocate had remained absent.

cp.51.2012_22.doc 3.

They were present only on one occasion on 3.11.2017. The matter has been listed even thereafter and repeatedly. Though listed but could not be taken up, we find that the petitioner is not evincing any interest. The Contempt Petition, alleging breach of the order of the Division Bench but essentially seeking its enforcement, need not be pursued further. It is therefore disposed off accordingly.
