In view of consent extended, present application stands allowed in terms of paragraph 2 of the order dated 16th December, 2021, which reads thus :- "2.The respondent husband is represented through the learned Advocate. He fairly state that he has instructions to give No objection for transferring the proceedings filed by him in the Family Court at Bandra, Mumbai to the Court at Pune. However, since the proceedings filed by the wife are in the Court of JMFC, Cantonment Court, Pune, the Magistrate may not be in a position to entertain M.J. Petition No.79 of 2020, wherein a declaration is sought to the effect that the petitioner therein shall be declared as legal guardian of the minor child and her custody shall be granted to him. He is however, open to a suggestion that if both the proceedings i.e. the proceedings filed by the applicant wife under the Domestic Violence Act as well BGP.

as his M.J. Petition No.79 of 2020 are made over to the Family Court at Pune, both the parties would have their own convenience."

Learned counsel for the applicant consents for expeditious disposal of the interim application for access and custody.

As such, this Court expects Trial Court shall decide the same expeditiously.
