Learned counsel for the applicant submits that the appeal was dismissed for default by conditional order dated 10.10.2016 passed by the Registrar (Judicial-II), as the applicant did not pay the necessary Court Fees. Now, the applicant is ready to pay the Court Fees and, therefore, he prays that the order dated 10.10.2016 passed by the Registrar (Judicial-II) be set aside. He further submits that there is a delay of 62 days in filing the Civil Application. He prays that the delay of 62 days be condoned.

In view of the submissions, the order dated 10.10.2016 passed by the Registrar (Judicial-II) is set aside. Appeal is restored to its original file. The applicant is directed to pay the Court Fees on or before 11.10.2017, if not paid, the matter will be dismissed without referring to the Court.
