This is an application for bail filed by the applicant who is facing trial in Sessions Case No.23 of 2012 pending on the file of Addl. District and Sessions Judge, Baramati.

Mrs. Mulekar, the learned APP for the State has placed on record a report by PI Baramati Police Station which reveals that the trial has commenced and 10 witnesses are already examined and only two witnesses i.e. Medical officer and investigating officer are to be examined. Since the case is at a fag end, I do not wish to exercise the discretion under Section 439 of Cr.P.C.

Hence the application is dismissed with directions to the

jsn 26 BA No.144_2016 learned Sessions Judge to dispose of the case as expeditiously as possible and in any event within a period of six months from the date of the receipt of the order.

Registry to pay the professional fees of the counsel appointed from Legal Aid Panel.
