This Writ Petition is filed by husband challenging an order passed on 26 December 2023 in Marriage Petition filed by husband before the Family Court at Bandra.

The Petitioner had filed a Marriage Petition under Section 12 (1) (d) for declaring the marriage between petitioner and respondent as null and void under the Hindu Marriage Act, 1955. In the said marriage petition an order was passed of 'NoWS'. The said order of no-WS was challenged by the wife by filing an application at Exhibit-20. By an order dated 26 December 2023 the Family Court at Bandra, Mumbai allowed the application filed by the wife and set aside the no-WS order subject to payment of cost of Rs.2,000/- to Petitioner.

Heard. I have gone through the contents of the Writ Petition. Suffice would be the purpose if the writ petition disposed of with the following directions :- (i) The respondent immediately pay a cost of Rs.2,000/- as directed by the Family Court dated 26 December 2023 to the Petitioner, within a period of two weeks from today.

(ii)The order dated 26 December 2023 is passed by the Family Court at Bandra is hereby confirmed.

(iii) The interim maintenance application filed by the wife, to which reply has already been filed by the husband to be decided by the Family Court at Bandra expeditiously and in any case to be heard and disposed of within a period of four weeks from today.

(iv) After interim maintenance application is decided the Family Court at Bandra, the hearing of the Marriage Petition No.929/2021 is also hereby expedited. The Family Court should make an endevour to dispose of the same as early as possible and should try to dispose of the same within a period of one year from today.

(v) The Petitioner is also directed to pay (in advance at least 48 hours) a sum of Rs.2,000/- as traveling expenses to the respondent for each and every date of the hearing.
