Heard the learned counsel for the applicants. Perused the impugned order. The impugned order is based on the complaint and verification statement. The applicants allegedly stated in their written statements in Regular Suit No. 5 of 2014, pending in the Court of Civil Judge, Senior Division, Malegaon, that respondent No. 2 (complainant) is the regular panch of police. Respondent No. 2 1/2

8)APL75.15 felt defamed due to the said statements made by the applicants. Therefore, a complaint u/s 500 of IPC has been lodged against the applicants and the summons has been issued by the Court. The contention of the learned counsel for the applicant is that they there was no publication of the alleged defamatory material. This cannot be accepted as the alleged defamatory material finds place in the written statement. I do not find any substance in the application. The application stands dismissed summarily.
