Heard learned counsel for the applicant and learned APP for the State.

The complainant filed a complaint with the police station that the applicant failed to handover the delivery of the ambulance, though the complainant had paid a substantial consideration for the said purchase. According to learned counsel for the applicant, the applicant is willing to handover the ambulance subject to completing the documentation and payment of necessary registration charges.

Learned APP submits that there is no FIR filed so far 1/2

In any case, considering the nature of the allegations, the applicant will have to be issued notice under Section 41-A of the Code of Criminal Procedure. If and when the notice is issued under Section 41-A, liberty to the applicant to apply afresh for anticipatory bail.
