P.C:- Mr. Upadhye, learned Counsel appearing in support of the Petition, on instructions, seeks to withdraw this Petition, so as to file an appeal to this Court from order dated 11th December, 2017 of the Customs, Excise and Service Tax Appellant Tribunal (the Tribunal) under Section 35-G of the Central Excise Act, 1944. Liberty as prayed for, granted.

Needless to state that delay in filing the appeal would be considered by the Court, hearing the appeal to which application for condonation of delay would be made. It would be decided on its own merits .
