WP. 2642-14 VPH
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION WRIT PETITION No. 2642 OF 2014 Smt. Savitri Bhagwan Mhatre ...
Petitioner Vs.
The State of Maharashtra & Ors.
...
Respondents *** Mr. Nitin Dalvi, for the Petitioner.
Mr. C. P. Yadav, AGP for the Respondent - State. *** CORAM : V. M. KANADE, & M. S. SONAK, JJ.
DATE : AUGUST 8, 2016 PC.
.
Heard the learned counsel appearing on behalf of the Petitioner. The Petitioner's services were terminated on the ground that she has produced bogus S.S.C. certificate. A departmental inquiry was initiated against the Petitioner for misleading and cheating the Government.
The Petitioner approached the Maharashtra Administrative Tribunal. Initially, the Tribunal, in the first round of litigation, remanded back the matter and directed the Disciplinary 1 / 2
WP. 2642-14 Authority to pass a reasoned order. Accordingly, the reasoned order was passed on 25th July, 2012. This order was also challenged by the Petition by filing OA before the Tribunal. The Tribunal dismissed the said OA by passing a reasoned order. In paragraph 5 of the said impugned order, there is finding that both the Janta Vidhalay in which Petitioner was studying, as well as SSC Board have clarified that the SSC certificate was bogus. We do not see any reason to interfere with the well reasoned order of the Tribunal. Writ petition is, therefore, dismissed.
