The above Miscellaneous Civil Application is filed by the Applicant wife seeking transfer of divorce proceedings filed by the Respondent husband, being Marriage Petition No. 448 of 2013 from the Court of the Learned Civil Judge, Senior Division, Thane, to the Family Court at Sangli. 2.
Both the parties are of the view that they will be inconvenienced if they are required to travel, and since the Court of Civil Judge, Senior Division, Thane as well as the Family Court at Sangli are equipped to conduct matters through video conferencing, the parties have agreed to conduct the proceedings through video conferencing, and the following order is passed by consent:
KPPNair -2- (i) Marriage Petition No. 448 of 2013 filed by the Respondent and pending before the Civil Judge, Senior Division, Thane shall be proceeded with by video conferencing.
(ii) The Family Court/District Court at Sangli, shall render all assistance to the Applicant, and allow her to use the video conferencing facility available in their premises.
(iii) The Family Court at Sangli shall allow the Applicant wife to affirm the pleadings for being sent to the Court of Civil Judge, Senior Division, Thane. (iv) The Civil Judge, Senior Division, Thane shall not grant any adjournment to the parties unless absolutely necessary. The parties too shall not seek any adjournment unless absolutely necessary. (v) The Learned Civil Judge, Senior Division, Thane, shall endeavour to dispose of Marriage Petition No. 448 of 2013 within a period of six months from the date of this order.
(vi) Since the proceedings shall be conducted through video conferencing, the Civil Judge, Senior Division, Thane shall fix the hearing of the matter at the time specified in advance.
(vii) The Respondent undertakes that he shall continue to pay maintenance to the Applicant as directed by the Judicial Magistrate, First Class, Atpadi, by his order dated 7th August, 2015, until further orders by the appropriate Court.
