Anticipatory Bail Application No.1635 of 2016 decided on 19.12.2016. Heard learned Counsel for applicant and learned A.P.P. By this application applicant prays for relaxation of condition imposed by this Court while granting him bail by which applicant was directed to attend concerned Police Station on first Sunday of each month till the filing of the charge-sheet. Applicant has come out with a case that he has since regularly complied with condition, however, submits that though this condition was to be in force till filing of charge-sheet, Division Bench of this Court in a Petition filed by co-accused for quashing of F.I.R. Waghmare 1/2

37.APPP.83.19 in ABA.1635.16.doc by its order dated 12.01.2017 passed in Writ Petition No.3776 of 2016 had directed not to file charge-sheet without leave of this Court. Learned Counsel for applicant, therefore, submits that the Petition may take sufficient time for its final disposal and in that circumstances condition imposed is required to be modified. Submissions advanced finds to be convincing, even otherwise applicant is retired Head Master, in the circumstances, order is modified as under :

ORDER

Applicant shall attend Investigating Officer if called till the filing of charge-sheet.

Application is allowed in above terms.
