After arguing for sometime, when the Court was not inclined to grant the relief i.e. of quashing of the proceedings under its inherent jurisdiction and under Article 226 of the Constitution of India, learned Counsel for the petitioners sought leave to withdraw the petition with liberty to file a discharge application before the Wakodikar 1/2
42. WP 556-2020.doc appropriate Court.

The petition is accordingly disposed of as withdrawn with liberty as prayed.

If an application seeking discharge is filed by the petitioners before the trial Court, the learned Judge to consider the said application on its own merits, in accordance with law, uninfluenced by the withdrawal of the aforesaid petition. 4.
Needless to state that all contentions of the parties on merits are kept open.

All concerned to act on the authenticated copy of this order.
