Heard the learned counsel for the applicant and the learned Special Public Prosecutor for the respondent - State.

By this application, the applicant seeks relaxation/modification of the condition of attendance, imposed by this Court (Coram : Hon'ble Shri Justice A.R.Joshi) vide

order dated 17.04.2014, to the extent that, it directs the applicant to attend the local MIDC Police Station, Andheri, Mumbai, on every Sunday till the disposal of the case against the applicant.

It appears that the applicant was enlarged on bail vide order dated 31.01.2013 passed by the Court (Coram : Hon'ble Shri Justice A.M.Thipsay) in Cri.B.A.No.1692 of 2012. Amongst other conditions, this Court vide the said order had directed the applicant to attend the Hingna Police Station, Nagpur on every Sunday till the disposal of the case against her. Subsequently, the applicant preferred an application, being Cri.B.A.No.195 of 2014 in Cri. Bail Appln. No.1692 of 2012 seeking modification/relaxation of the condition of attendance and this Court (Coram : Hon'ble Shri Justice A.R.Joshi) vide order dated 17.04.2014 was pleased to modify the said condition of attendance from Hingna

Police Station, Nagpur to that of MIDC Police Station, Andheri on the 1st Sunday of every month between 10.00 a.m. to 12.00 noon till the conclusion of the trial Court.

The learned counsel for the applicant states that the applicant has moved back to Nagpur after her marriage and hence, again seeks relaxation/modification of the said condition of attendance from the MIDC Police Station, Andheri to the Imamwada Police Station, Nagpur.

The learned Special Public Prosecutor states that the trial of the applicant i.e. Sessions Case No.655 of 2011 is likely to start from 12.05.2015 and has no objection, if the said condition is relaxed/modified as the applicant will be required to attend the concerned Special Court for the hearing of the criminal case. She has no objection, if the condition is relaxed/modified, and the

applicant is directed to attend the Imamwada Police Station, Nagpur instead of MIDC Police Station, Andheri, Mumbai.

Accordingly, the application is allowed. The condition of attendance to the MIDC Police Station, Andheri, Mumbai is relaxed/modified. The applicant shall, now, attend the Imamwada Police Station, Nagpur on the 1st Sunday of every month between 10.00 a.m. to 12.00 noon till the conclusion of the trial Court.

The application is disposed of on the aforesaid grounds.
