Mr. Shah, learned Counsel appearing for the Petitioner, on instruction, seeks to withdraw this Petition with liberty to approach the District Judge, Pune who has passed the impugned order dated 2nd January, 2016.This to bring to the notice of the District Judge, what according to the Petitioner, has been a breach of the statement made by Respondent Nos.1 to 5 - Original Defendants, during the course of hearing, leading to the impugned order dated 2nd January, 2017. Liberty as prayed for, granted.

It is made clear that I have not examined the merits of the contention urged by the Petitioner.

Petition is dismissed as withdrawn, with the aforesaid liberty.
