This is an application seeking restoration of Criminal Application No. 108 of 2017, which is dismissed for want of prosecution by an order dated 20/3/2018 for non compliance of the conditional order. There is a delay of 163 days in filing criminal application seeking restoration. For the reasons assigned in paragraphs-3, 4 and 5 of the application and the submission advanced across the bar, the delay deserves to be condoned and the matter deserves to be restored to the original status. Hence, the application is allowed in terms of prayer clause (b) and (c). The application stands disposed of. The applicant shall cause fresh service upon the respondent and he would file affidavit of service within four weeks from today.
