The applicant has been granted interim relief by an order dated 02.02.2017. By the said order the applicant was directed to attend the Investigating Officer on stipulated time and to co-operate with the Investigating Agency.

Learned APP, on instructions from the Investigating Officer who is present in the Court, submitted that the applicant has complied with the said condition.

I have perused the record annexed to the application and the papers of investigation. The applicant is the conductor of the Mela Restaurant and Bar and situated within the jurisdiction of Kashimira Police Station. That the applicant was not present at the spot when the alleged raid was conducted by the police. It further appears from the record that the victim women, who were found at the spot, were major in age and 1/2
(14) ABA 112-17 were indulging in the activities of dancing at their own volition. 4.
In view of the facts of the present case, I am of the opinion that the custodial interrogation of the applicant is not necessary. The interim relief granted by the order dated 02.02.2017 is hereby confirmed. However, the applicant is directed to attend the concerned police station as and when called for between 11.00 a.m. to 1.00 p.m. and to join the process of investigation till the charge-sheet is filed. 5.
