From the order dated 21st November 2016 it appears that a pursis was given to the Additional Sessions Judge, Malegaon stating that the applicants does not proceed the application and, therefore, the application was disposed of. In view of this, the application under section 438 of Cr.P.C. cannot be entertained. However, the applicants may approach the Sessions Court.
