Heard learned Advocate Mr. Desai for the Petitioner and learned additional public prosecutor for the State. Perused the impugned order. The petitioner is the accused for the offence punishable under section 138 of the Negotiable Instruments Act. He wanted the cheque in question to be sent to the document examiner on the ground that the amount is not filled in by him and the cheque does not bear his signature.

I have gone through the cross-examination of the PW-1/Complainant. It is nowhere suggested to PW-1 that the cheque was not signed by the petitioner and that the amount Borey 1/2

spb/ 11wp318-15.sxw was not filled in by the petitioner/applicant. It appears that the petitioner wants to delay the trial on some or the other grounds. There is no substance in the petition. The writ petition stands dismissed summarily. (JUDGE) .....
