Mr.Jetly, learned Counsel for the Respondents raises preliminary objection that the petitioner has remedy of appeal under the Statute. 2.

In view of that, though the learned Counsel for the petitioner sought to canvass submission on merit, we are not inclined to consider the same.

Accordingly, the Writ Petition is disposed of with a liberty to avail an alternate remedy. All contentions of the respective parties are kept open. No order as to costs.
