2. The learned counsel waive notice of Rule.

3. Heard finally at the stage of admission by consent of the parties.

4. In this Criminal Writ Petition, the petitioner prays that the learned Metropolitan Magistrate, 70th Court, Sewree be directed to pass an order on an application for renewal of passport made by the petitioner.

5. In view of the prayer made and considering the nature of the relief, it is not necessary to give notice to the respondent / original complainant. Perused the Roznama dated 15th December 2018. On that day, it appears that the matter was scheduled on 21st December 2018 for cross examination and to pass an order on passport application. The learned Counsel submits that till today, the learned Magistrate has not passed any order on application for renewal of passport.

6. Writ Petition is therefore allowed with the following order;

ORDER

i) Learned Metropolitan Magistrate, 70th Court, Sewree is directed to decide the application of renewal of passport on merit on 6th February 2019.

ii) Rule made absolute accordingly.

iii) Writ Petition stands disposed of.
