In view of urgency, taken on production board. 2] According to the learned counsel for the petitioner, the question involved in this petition has already been decided by this Court in the case of Jyoti Prakash Chougule vs. State of Maharashtra & Ors. in writ petition no. 2354 of 2012 decided on 7th January 2014 and in the case of Sou. Rashmi Shriram Mone vs. State of Maharashtra 2017 (3) ALL MR 703. He made a prayer that this petition may be disposed of by directing the respondent no. 4 to consider the petitioner's claim afresh without being influenced by the impugned rejection order dated 28th November 2016 (Exhibit 'C'). 1/2

skc 2 506-WP-4186-17.sxw 3] Keeping in view the aforesaid prayer, as agreed by the learned counsel for the parties, we dispose of this petition by directing the respondent no. 4 to consider and take appropriate decision afresh in regard to the petitioner's claim keeping in view the decisions in the case of Jyoti Prakash Chougule (supra) and Rashmi Shriram Mone (supra). The decision as aforesaid be taken within three months from the date of receipt of copy of this order without being influenced by the impugned order (Exhibit 'C').
